Terms of Service

These Terms of Service ("Terms") govern your access to and use of Pitchanite (the "Service"). The Service is operated by Threepoints Lab Ltd, a company registered in England and Wales, with its registered office at 5 Brayford Square, London, England, E1 0SG ("Pitchanite", "we", "us", or "our").
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Pitchanite is an outreach platform that helps content creators and micro-influencers find brands, create personalised pitch emails, send those emails from their own connected email account, and track replies. We provide the tools and infrastructure; you are responsible for the content you send and the way you use the Service.
2. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you confirm that you are 18 or older and that you have the authority to enter into these Terms.
3. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep it up to date. Notify us promptly if you believe your account has been used without your authorisation.
4. Connecting Your Email Account
The Service allows you to connect your own email account, such as Gmail, so that pitches and follow-ups are sent from your inbox. When you connect your account, you authorise Pitchanite to send emails on your behalf and to detect replies for the purpose of reply tracking, as described in our Privacy Policy.
You remain the sender of every email sent through the Service and are solely responsible for its content and for compliance with applicable laws, including anti-spam and data protection laws. You can revoke Pitchanite's access to your email account at any time.
5. Acceptable Use
You agree to use the Service lawfully and responsibly. In particular, you are responsible for having a proper basis to contact each recipient you email through the Service, and you must comply with all applicable anti-spam and data protection laws, including the UK GDPR and PECR, the EU GDPR, the US CAN-SPAM Act, and Canada's Anti-Spam Legislation (CASL), where they apply to your outreach. You must honour unsubscribe and opt-out requests promptly.
You must not use the Service to send unlawful, deceptive, harassing, or infringing content, to send unsolicited bulk email in breach of applicable law, or to bypass or interfere with the Service's sending limits, security, or deliverability safeguards. We may suspend or limit sending activity to protect the deliverability and integrity of the Service.
6. AI and Automated Features
Some features of the Service use automated systems and artificial intelligence to generate pitch drafts, suggestions, and follow-up content. You acknowledge that automated outputs may be inaccurate, incomplete, or unsuitable, and are provided for your convenience only. You are solely responsible for reviewing, editing, and approving all content before it is sent, and you remain fully responsible for everything sent through the Service. We make no guarantees about the accuracy, suitability, or results of any automated output.
7. Email Deliverability
Email deliverability, inbox placement, sender reputation, and reply rates depend on many factors outside our control, including recipient mail servers, your own sending history, and how you use the Service. We make no guarantees regarding deliverability, inbox placement, reply rates, or the outcome of any outreach. You are responsible for using the Service in line with good sending practice and applicable law. We are not liable for deliverability issues, damage to your domain or sender reputation, or restrictions placed on your email account by your email provider that result from your use of the Service.
8. Contact Data
The Service includes access to a database of business contact information that we maintain ("Contact Data") to help you carry out business-to-business outreach to brands. With respect to Contact Data:
- We process Contact Data as an independent controller on the basis of our legitimate interest in facilitating business-to-business outreach between creators and brands.
- When you access and use Contact Data to send outreach, you act as an independent controller for that processing and are responsible for having a lawful basis for it under applicable data protection law.
- You must use Contact Data only for legitimate business-to-business outreach and in compliance with all applicable laws.
- You must promptly honour any opt-out, unsubscribe, or deletion request you receive from a contact.
- We maintain a mechanism allowing individuals to request removal from the database.
9. Plans, Pricing, and Payment
We offer a free plan and paid plans (Pro, Scale, and a Founding Member lifetime plan). Plan features, limits, and prices are shown at the point of purchase. Payments are processed by our payment provider, Stripe; we do not store your full card details. Paid subscriptions are billed in advance on a recurring basis (monthly or annually) until cancelled. You authorise us to charge your chosen payment method for the applicable fees.
We may change our prices from time to time. Any change to the price of a recurring subscription will apply from your next billing period, and we will give you reasonable notice.
10. Founding Member Lifetime Plan
The Founding Member plan is a one-time payment that grants access to the corresponding plan features for the lifetime of the Service. "Lifetime" means for as long as we continue to operate the Service. We may modify or discontinue the Service, or the Founding Member plan, with reasonable prior notice. If we discontinue the Service entirely, lifetime access will end at that point. Lifetime access is personal to your account and may not be transferred or resold.
11. Cancellation and Refunds
You can cancel a subscription at any time from your account settings. When you cancel, you keep access to the paid features until the end of your current billing period, and you will not be charged again after that.
Refunds
- Monthly and annual plans (Pro, Scale): Fees are non-refundable once you have used paid pitches beyond the free allowance. Partial billing periods are not refunded.
- Founding Member lifetime plan: You may request a full refund within 14 days of purchase only if you have not used the plan beyond the free limit. Once you have used the plan beyond the free limit, the payment is non-refundable.
Nothing in these Terms affects your statutory rights as a consumer under UK law, including any legal right to a refund that cannot be excluded. Where such rights apply, they take precedence over the refund terms above.
12. Your Content
You retain ownership of the content you create and send through the Service, including your pitches, persona details, and campaign data. You grant us a limited licence to process and transmit that content solely to provide the Service to you. You are responsible for ensuring you have the right to use and send the content you create.
13. Our Intellectual Property
The Service, including its software, design, branding, and content we provide, is owned by Threepoints Lab Ltd and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. You may not copy, modify, resell, reverse engineer, or create derivative works from the Service without our permission.
14. Third-Party Services
The Service integrates with third-party services, including Google and the Gmail API. Your connection and use of Gmail through the Service is also subject to Google's own terms of service and privacy policy, and your relationship with Google is separate from your relationship with us. We are not responsible for third-party services, and where the Service relies on a third party, its availability may depend on that third party.
15. Service Availability
We aim to keep the Service available and reliable, but we do not guarantee that it will be uninterrupted, error-free, or that emails will always be delivered, as deliverability depends on factors outside our control, including recipient mail servers. We may modify, suspend, or discontinue features of the Service from time to time.
16. Disclaimers
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including any implied warranties of satisfactory quality, fitness for a particular purpose, and non-infringement. We do not warrant any particular outcome from using the Service, including any number of replies, deals, or brand partnerships.
17. Limitation of Liability
To the fullest extent permitted by law, Pitchanite will not be liable for any indirect, incidental, special, or consequential losses, or for loss of profits, revenue, data, or business opportunities, arising from your use of the Service. Our total liability to you for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the event giving rise to the claim.
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, or for fraud.
18. Indemnity
You agree to indemnify and hold Pitchanite harmless from any claims, losses, liabilities, and reasonable expenses (including legal costs) arising from your use of the Service, the content you send, your breach of these Terms, or your violation of any law or third-party rights. This does not apply to the extent a claim results from our own breach of these Terms or our negligence.
19. Suspension and Termination
We may suspend or terminate your access to the Service if you breach these Terms, use the Service unlawfully, or in a way that risks harm to the Service, other users, or third parties. You may stop using the Service and close your account at any time. Provisions that by their nature should survive termination, such as intellectual property, disclaimers, and limitation of liability, will continue to apply.
20. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. If we make material changes, we will provide reasonable notice. Your continued use of the Service after changes take effect means you accept the updated Terms.
21. General
If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full effect. We will not be liable for any failure or delay in performing our obligations where it results from events beyond our reasonable control. You may not transfer your rights under these Terms without our consent; we may transfer ours as part of a reorganisation or sale of the business. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Service.
22. Governing Law
These Terms are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction over any dispute arising from these Terms or the Service, subject to any mandatory consumer protection rights that entitle you to bring proceedings in your country of residence.
